Designated Agent

Notice of Claimed Infringement

If you believe content displayed within PokeChronicle infringes your copyright, send a written notice to the designated agent above that includes all of the following, per 17 U.S.C. § 512(c):

1. A physical or electronic signature of the copyright owner or authorized agent.
2. Identification of the copyrighted work claimed to be infringed.
3. Identification of the material claimed to be infringing, with information sufficient to locate it on the Service (e.g., URL).
4. Your contact information (address, telephone number, email).
5. A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
6. A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Counter-Notification

If you believe your content was removed or disabled in error or misidentification, you may submit a counter-notification to the designated agent containing:

1. Your physical or electronic signature.
2. Identification of the material that was removed and the location at which it appeared before removal.
3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
4. Your name, address, telephone number, and a statement consenting to the jurisdiction of the federal district court for the judicial district in which your address is located (or if outside the US, any district in which we may be found).

Repeat Infringers

In accordance with the DMCA and other applicable laws, REMbyDesign LLC maintains a policy of terminating, in appropriate circumstances, accounts of users who are repeat infringers of intellectual property rights.

Good-Faith Notice

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be liable for damages, including costs and attorneys’ fees.
