Terms of Service

Template notice. This document is a foundational template provided for coverage and clarity during early access. It is subject to review and revision by legal counsel as PokeChronicle matures. By using this service during its current beta, you acknowledge terms may be updated as the platform evolves.

1. Acceptance of Terms

By accessing or using PokeChronicle (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PokeChronicle is an independent, fan-made companion application for Pokémon Trading Card Game (TCG) collectors. The Service provides tools for tracking personal card collections, completing educational lessons, joining community guilds, and viewing publicly available card data. PokeChronicle is not a marketplace and does not facilitate transactions.

PokeChronicle is operated by REMbyDesign LLC (“we”, “us”, “our”). PokeChronicle is not affiliated with, endorsed by, sponsored by, or otherwise associated with Nintendo, Game Freak, Creatures Inc., The Pokémon Company, The Pokémon Company International, or any related entity.

3. Account Registration & Eligibility

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this age requirement and that all information you provide is accurate and current. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

4. Acceptable Use

You agree not to:

Scrape, crawl, or programmatically access the Service except via published APIs;
Attempt to circumvent rate limits, security controls, or access controls;
Impersonate any person or entity, including by claiming a handle that misrepresents identity;
Upload or transmit content that infringes intellectual property rights;
Use the Service to harass, abuse, or harm other users;
Reverse engineer, decompile, or disassemble the Service except as permitted by law.

5. Subscription Terms

Paid subscriptions, when offered, automatically renew at the same billing interval until canceled. You may cancel at any time via your account settings; cancellation takes effect at the end of the then-current billing period. Refunds are evaluated on a case-by-case basis and are not guaranteed. By subscribing, you authorize PokeChronicle to charge your payment method on the recurring schedule shown at checkout. Payments are processed by Stripe; we do not store full payment card data.

6. User Content

You retain ownership of content you create within the Service (display names, bios, custom notes, collection data). By posting public content (e.g., your Chronicle profile), you grant PokeChronicle a non-exclusive, worldwide, royalty-free license to display that content within the Service for the purpose of providing the Service to you and others.

7. Intellectual Property

The PokeChronicle name, logo, brand, original written content, and source code are the intellectual property of REMbyDesign LLC. Pokémon names, character likenesses, card images, and related trademarks remain the property of their respective owners; their display within PokeChronicle is for informational, identification, and personal collection-management purposes only.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, REMBYDESIGN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU TO POKECHRONICLE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless REMbyDesign LLC, its officers, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party right.

11. Termination

We may suspend or terminate your account at our discretion for violation of these Terms, suspected fraud, or to comply with legal obligations. You may delete your account at any time via your account settings; deletion is permanent and cannot be undone.

12. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via the Service or by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws principles. Any dispute arising from these Terms shall first be addressed through good-faith informal negotiation. If unresolved, disputes shall be resolved by binding arbitration in King County, Washington, in accordance with the rules of the American Arbitration Association, except that you may bring a claim in small-claims court if eligible.
